Terms of Service

1. Agreement to Terms

By accessing or using the CarouselKit service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

This Service is operated by Jaak Daemen, an individual operator based in Ghent, Belgium. Contact: jaak.daemen03@gmail.com

2. Eligibility

You must be at least 16 years of age to use this Service. By using this Service, you represent and warrant that you are at least 16 years old.

3. Description of Service

The Service is an AI-powered tool that generates professional LinkedIn carousel posts based on user-provided text prompts. The Service includes:

  • AI-generated carousel content (10 pages per carousel)
  • PDF export functionality
  • User account management
  • Credit-based usage system

4. User Accounts

To use the Service, you must create an account using Firebase Authentication. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use of your account

5. Credits and Payment

5.1 Credit System

The Service operates on a credit-based system. One (1) credit allows you to generate one (1) LinkedIn carousel. Credits must be purchased before use.

5.2 Credit Expiration

Purchased credits expire a minimum of 4 months after the date of purchase. We reserve the right to extend this period at our discretion, but credits may expire after the minimum 4-month period. Expired credits cannot be used or refunded.

5.3 Payments

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms and conditions. Prices are displayed in Euros (EUR) and include applicable taxes.

5.4 No Refunds

All credit purchases are final and non-refundable. This includes cases where credits expire unused. Once credits are used to generate a carousel, the transaction cannot be reversed.

5.5 Service Availability

We reserve the right to limit the availability of credits based on operational capacity and costs. The Service may become temporarily or permanently unavailable due to external dependencies (see Section 7).

6. PDF Storage and Retention

Generated carousel PDFs are stored temporarily on our servers:

  • Session PDFs: Stored for 14 days after generation for viewing and revision purposes
  • Download PDFs: Available for immediate download only (10 minutes)

After 14 days, all PDFs are automatically and permanently deleted from our servers. We do not maintain long-term backups of your generated carousels. You are responsible for downloading and storing your carousels within this period.

7. External Service Dependencies

Important: This Service relies on third-party AI providers for carousel generation. The availability, quality, and performance of the Service are dependent on these external providers.

We are not responsible for:

  • Service interruptions caused by third-party AI providers
  • Changes to third-party API pricing or availability
  • Quality or accuracy of AI-generated content
  • Service termination if external providers become unavailable or too costly to maintain

Service Sustainability: This Service has limited operational capacity and relies on paid subscriptions to third-party services. We reserve the right to suspend or terminate the Service at any time if operational costs become unsustainable or if external service providers are no longer available.

8. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Distribute spam, malware, or harmful content
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Use automated tools to abuse or overload the Service
  • Generate content that violates LinkedIn's terms of service

We reserve the right to suspend or terminate accounts that violate these terms.

9. Intellectual Property

9.1 Your Content

You retain all rights to the text prompts and content you provide to the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of generating carousels.

9.2 Generated Content

You own the carousels generated by the Service. However, we cannot guarantee that generated content is unique or does not infringe on third-party rights. You are responsible for ensuring your use of generated content complies with applicable laws and does not infringe on others' rights.

9.3 Service Ownership

The Service itself, including its design, code, algorithms, and branding, is owned by the operator and is protected by intellectual property laws.

10. Disclaimers and Limitation of Liability

10.1 "AS-IS" Service

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Generated content will be accurate, complete, or suitable for your purposes
  • The Service will meet your expectations or requirements
  • Defects will be corrected

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability to you shall not exceed the amount you paid for credits in the past 3 months
  • We are not liable for losses caused by third-party service providers, external APIs, or circumstances beyond our control

10.3 No Professional Advice

The Service is for informational and creative purposes only. Generated content should not be considered professional advice of any kind. You are solely responsible for reviewing and verifying all content before use.

11. Indemnification

You agree to indemnify and hold harmless the operator, Jaak Daemen, from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate or distribute using the Service

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:

  • Your access to the Service will be revoked
  • Unused credits will be forfeited (no refunds)
  • Your data will be handled according to our Privacy Policy

You may delete your account at any time through the Service interface or by contacting us.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms. Material changes will be communicated via email or a notice on the Service.

14. Customer Support & Problem Resolution

14.1 Contact Us First

If you experience any problems, bugs, or issues with the Service, please contact us directly at jaak.daemen03@gmail.com before taking any other action.

We are committed to providing a positive user experience and actively want to hear about any issues you encounter. Direct communication allows us to:

  • Quickly address and resolve technical problems
  • Improve the Service based on your feedback
  • Potentially provide goodwill compensation (such as additional credits) at our sole discretion
  • Work with you to find a satisfactory solution

14.2 Before Contacting Payment Providers

Before initiating a chargeback or dispute with your payment provider (e.g., Stripe, credit card company), please contact us first. Most issues can be resolved directly and quickly through email communication. Initiating a payment dispute without first contacting us prevents us from working with you to resolve the issue and may result in account suspension.

14.3 Goodwill Gestures

While Section 5.4 states that purchases are non-refundable, we may, at our sole discretion, provide goodwill compensation such as additional credits, extended credit expiration periods, or other accommodations when issues arise. These goodwill gestures are voluntary and do not create any legal obligation or entitlement to future compensation.

14.4 Response Time

We aim to respond to all support inquiries within 48 hours during business days. For urgent technical issues, we will prioritize resolution as quickly as possible.

15. Governing Law and Disputes

These Terms are governed by the laws of Belgium. Any legal disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ghent, Belgium.

We strongly encourage informal resolution of disputes through direct communication before pursuing formal legal action.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the operator regarding the Service.
